Terms of Service

1. Agreement to these Terms

These Terms of Service (the “Terms”) are a binding agreement between AddHawk (“AddHawk”, “we”, “us”) and you. They govern your access to and use of the AddHawk websites, applications, and services (together, the “Platform”). By creating an account, or by accessing or using the Platform, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Platform. If you use the Platform on behalf of a business, you represent that you have authority to bind that business, and “you” includes it.

2. What AddHawk is — and is not

AddHawk is a marketplace and directory that connects people who need somewhere to receive packages (“Customers”) with independent businesses that receive packages for others (“Hosts”, and each of their published locations a “Listing”). AddHawk provides the venue, search tools, and payment facilitation.

AddHawk is not a shipping carrier, freight forwarder, warehouse, mail agent, or courier, and is not a party to the service arrangement between a Customer and a Host. Hosts are independent businesses, not employees, agents, or contractors of AddHawk. AddHawk never takes possession, custody, or control of any package. When you transact with a Host, your contract for the package receiving service is with that Host.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Platform. You must provide accurate registration information and keep it current. You are responsible for your account credentials and for everything done under your account; notify us at hello@addhawk.net immediately if you suspect unauthorised use. We may refuse, suspend, or terminate accounts as described in Section 16. You may not use the Platform if you are subject to economic sanctions or located in an embargoed jurisdiction.

4. Hosts and the Host Agreement

To publish a Listing or provide services to Customers, a Host must complete host onboarding and accept the Host Services Agreement, which is incorporated into these Terms for Hosts. Where these Terms and the Host Services Agreement conflict on a topic specific to hosting, the Host Services Agreement controls for Hosts.

5. Listings, search results, and verification

Listings are created by Hosts, who are solely responsible for their accuracy. AddHawk does not inspect Host premises and does not guarantee the accuracy, quality, safety, legality, or availability of any Listing or Host Service. Search ordering may consider relevance, distance, completeness, and performance signals. A “Verified” badge means only that AddHawk completed limited, point-in-time checks (such as business registration or address confirmation); it is not an endorsement or guarantee, and you should exercise the same judgment you would with any independent business.

6. Customer responsibilities

As a Customer, you agree that you will:

  • only have packages delivered to a Host with the Host’s consent, using the address format and any identifier the Host requires;
  • only receive packages that you have the legal right to receive, addressed to you or to a person who has authorised you in writing;
  • comply with any carrier and Host requirements, including USPS Form 1583 where a US Host receives letter mail for you;
  • collect packages within the Host’s stated holding period, and pay any disclosed storage or late-pickup fees;
  • present government-issued photo ID at pickup when the Host requires it;
  • never use a Host location to receive Prohibited Items (Section 7) or to further any unlawful purpose, including fraud, evasion of law enforcement, or circumvention of court orders.

7. Prohibited Items

You must not send to, store with, or ask a Host to handle any of the following (“Prohibited Items”): illegal drugs, controlled substances, or drug paraphernalia; firearms, firearm parts, ammunition, explosives, or other weapons; hazardous, flammable, corrosive, radioactive, or pressurised materials; improperly packaged lithium batteries; live animals; perishable goods (unless the Listing expressly supports them); human remains or biological samples; cash or bearer instruments beyond incidental value; counterfeit or stolen goods; items that violate sanctions or export control laws; and alcohol, tobacco, cannabis, or vaping products unless the transfer is lawful in the relevant jurisdiction and all required licences are held. Hosts may refuse any package, and packages reasonably suspected to contain Prohibited Items may be reported to law enforcement.

8. Fees and payments

Pricing. Hosts set the price of their services. AddHawk charges a platform fee on transactions completed through the Platform; the total you pay, including the fee, is disclosed before you confirm a transaction. Searching and browsing the directory is free.

Processing. Payments are processed by third-party processors: card and USDC (stablecoin) payments by Stripe, and Bitcoin payments by OpenNode. By paying, you also agree to the applicable processor’s terms. AddHawk does not store full payment card numbers and does not take custody of cryptocurrency; crypto payments are converted at a rate locked when you pay.

Cryptocurrency payments. Crypto network fees are borne by the payer. A crypto payment is complete when the processor confirms it; invoices that are underpaid, overpaid, or paid after expiry may be cancelled or require correction through the processor. Where a refund is owed on a crypto-paid transaction, it is calculated on the fiat value locked at payment time, not the amount of cryptocurrency originally sent, and may be issued in fiat.

Currency and taxes. Prices are shown in the currency indicated at checkout. You are responsible for any taxes, duties, or bank/exchange fees that apply to you. Where the law requires, applicable taxes are added and disclosed at checkout.

9. Refunds, cancellations, and disputes with Hosts

Because the service contract is between you and the Host, refunds and service disputes are in the first instance a matter between you and the Host, subject to the Host’s stated policies and your legal rights. AddHawk may — but is not obliged to — mediate, and may in its discretion refund the platform fee or the transaction. Contact hello@addhawk.net with your order details, and do so within 30 days of the issue where practicable. Nothing in this section limits rights you have under applicable consumer protection law.

10. Reviews and other user content

You may post reviews and other content. You retain ownership of your content and grant AddHawk a non-exclusive, worldwide, royalty-free, transferable licence to host, reproduce, display, distribute, and create derivative works of it for operating and promoting the Platform. Reviews must reflect your genuine experience. You must not post content that is false or misleading, defamatory, harassing, infringing, confidential to a third party, or unlawful; you must not post reviews of your own business or a competitor’s, exchange anything of value for reviews, or include other people’s personal information. We may remove content that violates these Terms and may preserve or disclose content where the law requires.

11. Acceptable use of the Platform

You must not:

  • use the Platform for any unlawful purpose or in violation of these Terms;
  • circumvent the Platform to avoid fees on transactions initiated through it;
  • scrape, harvest, or bulk-extract Platform data, or use it to build a competing directory;
  • probe, disrupt, overload, or attempt to gain unauthorised access to the Platform or others’ accounts;
  • upload malware or interfere with the Platform’s operation;
  • impersonate any person, misrepresent an affiliation, or create accounts by automated means;
  • infringe others’ intellectual property, privacy, or publicity rights.

12. Intellectual property

The Platform — including its software, design, text, graphics, logos, and trademarks — is owned by AddHawk or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose. No other rights are granted. If you believe content on the Platform infringes your copyright or other intellectual property rights, send a notice with the work identified, the infringing material’s location, your contact details, and a good-faith statement of infringement to legal@addhawk.net. We respond to valid notices, including under Canada’s notice-and-notice regime and, where applicable, the US DMCA, and may remove content and terminate repeat infringers.

13. Third-party services

The Platform relies on third-party services, including Supabase (authentication and data), Stripe and OpenNode (payments), map data providers, and email delivery services. Their availability is outside our control, and links to third-party sites are provided for convenience — we are not responsible for their content or practices. Your use of a third-party service is governed by that service’s own terms.

14. Privacy

Our collection and use of personal information is described in the Privacy Policy. Hosts receive Customer information solely to provide their services and are bound by the confidentiality and privacy obligations of the Host Services Agreement.

15. Disclaimers

To the maximum extent permitted by law, the Platform is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. AddHawk does not warrant that the Platform will be uninterrupted, secure, or error-free, that Listings are accurate, or that any Host or Customer will perform. AddHawk is not responsible for the acts or omissions of Hosts, Customers, or carriers, including loss of, damage to, or theft or misdelivery of packages. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

16. Suspension and termination

You may close your account at any time from your account page or by emailing hello@addhawk.net. We may suspend or terminate your access, remove content, or decline transactions where we reasonably believe you have violated these Terms or the law, created risk for other users, or where required by our payment processors or the law. Where practical we will give notice and an opportunity to respond. Sections that by their nature should survive termination (including 8–12, 15, 17–19) survive.

17. Limitation of liability and indemnity

To the maximum extent permitted by law: (a) AddHawk and its affiliates, officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data, arising out of or related to the Platform or these Terms; (b) AddHawk’s total aggregate liability for all claims arising out of or related to the Platform or these Terms is limited to the greater of the amounts you paid to AddHawk in the 12 months before the event giving rise to the claim and CAD $100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under applicable consumer protection legislation. You will indemnify AddHawk against third-party claims arising from your content, your use of the Platform in violation of these Terms, or your violation of law or third-party rights.

18. Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia, Canada and the federal laws of Canada applicable in it, without regard to conflict-of-law rules. Before starting a formal proceeding, you agree to contact us at legal@addhawk.net and attempt in good faith to resolve the dispute informally for 30 days. Subject to any mandatory rights you have under the consumer protection laws of your place of residence (which these Terms do not displace), disputes will be resolved exclusively in the courts of the Province of British Columbia, Canada, and the parties attorn to their jurisdiction.

19. Changes to the Platform and these Terms

We may change or discontinue features of the Platform. We may amend these Terms by posting the revised version with a new version number and effective date; for material changes we will give reasonable advance notice by email or on the Platform. If you do not agree to a change, stop using the Platform before it takes effect; continued use after the effective date constitutes acceptance.

20. General

These Terms, the Privacy Policy, and (for Hosts) the Host Services Agreement are the entire agreement between you and AddHawk about the Platform, and supersede prior agreements on that subject. You may not assign these Terms without our written consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. If any provision is held unenforceable, it will be modified to the minimum extent necessary and the remainder stays in effect. Our failure to enforce a provision is not a waiver. Neither party is liable for failure caused by events beyond its reasonable control. It is the parties’ express wish that these Terms and all related documents be drawn up in English; c’est la volonté expresse des parties que la présente convention ainsi que les documents qui s’y rattachent soient rédigés en anglais.
